You don't need to list every approved tool in your marketing materials — but prospective students should understand that AI use is governed, not chaotic. A: Publisher-embedded AI is one of the most underexamined compliance risks in educational technology. Major textbook publishers — Pearson, McGraw-Hill, Cengage — have integrated AI tutoring, adaptive assessment, and automated feedback tools into their platforms. When faculty assign textbooks through these platforms, students' interaction data flows into the publisher's AI systems. Whether that creates FERPA obligations depends on the specific data flows and your contractual relationship with the publisher. Best practice: require your compliance officer to review the data terms of any publisher platform before adoption, just as you would for a standalone AI tool. Several institutions discovered in 2024–2025 that publisher platform terms they'd never scrutinized included broad rights to student interaction data. That's a preventable problem.
Q: Should different programs have different levels of AI tool autonomy?
A: Yes, and building that differentiation into your framework makes it more functional. Programs with high regulatory oversight — allied health programs under ABHES or CAAHEP, teacher education programs under state board oversight — may need tighter central control over AI tools to satisfy regulatory documentation requirements. Programs with less external oversight and stronger cultures of pedagogical innovation — arts programs, graduate research programs — can likely operate with more teacher autonomy within your governance framework. The key is that these differences are documented and justified, not arbitrary. Your approved ecosystem framework handles this naturally: you can designate some tools as approved institution-wide, others as approved only for specific program types, and maintain the experimental tier for tools under evaluation.
Q: How should we handle AI tool requests from adjunct or part-time faculty?
A: Adjunct and part-time faculty represent one of the most significant AI governance blind spots in higher education. They often constitute 40–70% of instructional staff at many institutions, they receive less institutional training and support, and they're more likely to bring in outside tools without going through official channels — simply because they don't know the channels exist, or because the onboarding process never covered AI governance. Your approved ecosystem framework must explicitly address adjuncts: onboarding documentation should include your AI tool governance policy; training on the approved ecosystem should be available asynchronously so it doesn't require physical presence; and your AI tool governance committee should include at least one adjunct representative so the framework reflects the realities of how a large portion of your instruction actually gets delivered. Treating adjuncts as an afterthought in AI governance is one of the fastest ways to create the compliance gaps you're trying to prevent.
